By accessing or using Statly ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Description of Service

Statly is an observability platform that provides uptime monitoring, error tracking, status pages, and related services. We offer both free and paid subscription plans with varying features and limits.

Account Registration

To use Statly, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Promptly notify us of any unauthorized use of your account
Be at least 18 years old or have parental consent

You are responsible for all activities that occur under your account.

Acceptable Use

You agree not to:

Use the Service to monitor endpoints you don't own or have permission to monitor
Attempt to overwhelm or abuse monitored endpoints through excessive checks
Use the Service to distribute malware or conduct attacks
Circumvent any rate limits or usage restrictions
Resell or redistribute the Service without authorization
Interfere with or disrupt the Service or servers
Violate any applicable laws or regulations

Subscription and Billing

Free Tier

We offer a free tier with limited features. Free accounts may be subject to usage limits and reduced functionality.

Paid Subscriptions

Paid plans are billed monthly or annually as selected at checkout. Prices are subject to change with 30 days notice.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds are provided for partial months or unused time.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for any downtime or service interruptions.

Intellectual Property

The Service and its original content, features, and functionality are owned by Statly and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of data you submit to the Service.

Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless Statly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
